The Armed Forces Pension Group
lost there appeal at the recent hearing in the Hudson & Others v. MOD & Treasury, Case No. A3 2003
0594 QBENF. They was also ordered to pay the costs, and refused leave to Appeal to the House Of Lords.
The essence of the AFPG case was that, not with standing the MOD claimed the Pension Scheme was '
'Non-Contributory'', and members of the Armed Forces were required to serve at least 22 years to qualify for
a Pension, the MOD had in fact made deductions from their established Pay Levels, prior to 1975, to the
finance them. The AFPG considered that irrespective of the 22 year requirement to qualify for a Pension,
since they had, in fact, ''Contributed'' to a Pension from their earnings they are entitled to a Pro-Rata
Pension for the number of years served.
